Terms and Conditions
About these terms
These Terms and Conditions apply to the English by Kate website, online educational services and digital products.
By using this website, purchasing a product or booking a service, you agree to these terms. If you do not agree, please do not purchase or use the relevant product or service.
English by Kate may update these terms when its products, services or legal obligations change. The latest version will be published on this page.
Educational purpose
English by Kate provides English-language teaching, OET preparation, educational information and study resources.
Our products and services are intended for education and exam preparation. They do not constitute medical, legal, registration, immigration or employment advice.
Although we aim to provide accurate, useful and current educational material, individual results vary. Purchasing a resource or attending lessons does not guarantee:
- a particular OET or other examination score;
- admission to an examination;
- professional registration;
- employment; or
- any other specific result.
Students remain responsible for checking current examination, registration and professional requirements with the relevant official organisation.
Digital products
Digital products may include PDF workbooks, toolkits, practice activities, templates, model answers and other downloadable resources.
The product page will describe the main content and file format. Customers are responsible for ensuring they have a suitable device and software for opening the stated format.
Download access is normally provided after successful payment. If a download link or file does not work, contact ask@englishbykate.com.au for assistance.
Prices and payment
Unless otherwise stated, prices are displayed in Australian dollars.
Payments are processed securely through Stripe or another payment provider displayed at checkout. An order is not complete until payment has been successfully authorised.
English by Kate may correct genuine pricing or product-description errors. If an error materially affects an order that has already been placed, we will contact the customer and provide an appropriate solution.
Licence for digital resources
When you purchase a digital product, you receive a limited, personal, non-exclusive and non-transferable licence to use it for your own study.
You may:
- download the resource to your personal devices;
- make reasonable backup copies; and
- print copies for your own personal study.
Unless English by Kate provides written permission, you must not:
- share the product or download link with another person;
- email, upload, publish or distribute the product;
- reproduce the product for a class, workplace, organisation or group;
- sell, sublicense or commercially exploit the product;
- remove copyright or branding notices; or
- represent the product or any substantial part of it as your own work.
Teachers, organisations or other people wishing to use a resource with multiple learners should contact English by Kate to discuss appropriate permission or licensing.
Intellectual property
Unless otherwise stated, the website and its original content—including teaching materials, PDFs, text, exercises, templates, graphics, branding and product designs—are owned by or licensed to English by Kate and are protected by applicable intellectual-property laws.
No ownership rights are transferred when a product is purchased. All rights not expressly granted in these terms are reserved.
“OET” and other third-party names and trademarks belong to their respective owners. English by Kate is an independent education provider and is not endorsed by or affiliated with OET unless expressly stated.
Lessons and consultations
Lessons and consultations are booked separately through the booking service shown on the website.
Customers are responsible for:
- providing accurate booking and contact details;
- attending at the scheduled time;
- having a suitable device and reliable internet connection; and
- reviewing any cancellation, rescheduling or non-attendance terms displayed during booking.
Specific booking terms shown at the time of booking form part of the agreement for that service.
If English by Kate must cancel a scheduled service, we will offer a reasonable opportunity to reschedule or provide another remedy appropriate to the circumstances.
Student-provided material
Students may submit writing, role-play responses or other work for educational feedback.
You must not submit material that:
- infringes another person’s copyright or other rights;
- contains unlawful or harmful content; or
- includes identifiable patient information or confidential workplace information that you are not authorised to disclose.
Clinical scenarios used for teaching should be fictional, de-identified or officially supplied for educational purposes.
Refunds and consumer rights
Refunds and remedies are addressed in our Refund Policy.
Our products and services come with consumer guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded.
Website availability
We aim to keep the website, checkout and downloads available and secure, but uninterrupted or error-free access cannot be guaranteed.
We may temporarily suspend access for maintenance, security, updates or circumstances outside our reasonable control. If a customer cannot access a paid product, they should contact us so we can investigate and provide appropriate assistance.
Third-party services and links
The website and services may use or link to third-party providers, including Stripe, WooCommerce, Calendly, Google, Zoom and email-delivery services.
Third-party services are governed by their own terms and privacy policies. English by Kate is not responsible for the content or practices of unrelated external websites, but this does not exclude any responsibility that cannot lawfully be excluded.
Acceptable website use
You must not:
- misuse or attempt to disrupt the website;
- attempt to gain unauthorised access to accounts, files or systems;
- introduce malicious software;
- use automated methods to copy or extract substantial website content; or
- use the website or products for unlawful purposes.
We may restrict access where reasonably necessary to protect the website, customers, intellectual property or security.
Liability
To the extent permitted by law, English by Kate is not liable for loss arising solely from reliance on general educational information, a customer’s failure to meet external examination or registration requirements, or circumstances outside our reasonable control.
Nothing in this section excludes, restricts or modifies liability, consumer guarantees or other rights that cannot lawfully be excluded under Australian law.
Privacy
Personal information is handled in accordance with our Privacy Policy.
